Terms of Service

These Terms of Service ("Terms") govern your access to and use of SwingTrack websites, applications, and related services (the "Service"). By creating an account, signing in with Google or email, or otherwise using the Service, you agree to these Terms.

1. The Service

SwingTrack provides tennis video analysis tools, including uploads, imports, processing pipelines, and analytics outputs such as overlays and heatmaps. Features may change as we improve the product.

2. Eligibility and accounts

You must be old enough to form a binding contract where you live. You are responsible for safeguarding your credentials and for activity under your account. If you use Google sign-in, Google's terms and policies also apply to your use of Google's authentication services.

3. YouTube API Services

If the Service offers features that connect to YouTube (for example, importing or uploading videos via YouTube), your use of those features is also subject to the YouTube Terms of Service and the YouTube API Services Terms of Service. You grant only the permissions you explicitly approve in the OAuth consent flow. You may revoke access through your Google account settings at any time.

4. User content and license

You retain rights in videos and other materials you submit ("User Content"). You give us a non-exclusive license to host, process, transmit, display, and create derivative analytics outputs from User Content solely to operate, secure, and improve the Service for you. You represent that you have the rights needed to submit User Content and that doing so does not violate third-party rights (including broadcast or league restrictions where applicable).

5. Acceptable use

You agree not to:

  • Use the Service in violation of law or third-party rights;
  • Attempt to probe, scan, or test vulnerabilities without authorization, or bypass security;
  • Overload or interfere with the Service or other users' use;
  • Misrepresent your identity or misuse OAuth tokens or API access;
  • Upload unlawful, infringing, or malicious content.

6. Third-party services

The Service relies on third-party infrastructure and APIs (including Google, YouTube, cloud hosting, and payment processors). Their availability and terms are outside our control except as stated in your agreements with those providers.

7. Fees

Some features may require payment. If you purchase a subscription or one-time product, fees and billing terms are presented at checkout and may be governed by additional terms from our payment partner.

8. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. ANALYTICS AND COMPUTER VISION OUTPUTS MAY BE IMPERFECT OR INCOMPLETE; YOU ARE RESPONSIBLE FOR HOW YOU USE THEM.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SWINGTRACK AND ITS SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR AGGREGATE LIABILITY FOR CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE CLAIM OR FIFTY U.S. DOLLARS (IF YOU HAVE NOT PAID FEES).

10. Indemnity

You will defend and indemnify SwingTrack against claims arising from your User Content, your misuse of the Service, or your violation of these Terms, subject to applicable law.

11. Suspension and termination

We may suspend or terminate access if you violate these Terms, create risk or legal exposure, or if we discontinue the Service (with reasonable notice where practicable). You may stop using the Service at any time.

12. Changes

We may modify these Terms by posting an updated version on this page. If changes are material, we may provide additional notice. Continued use after the effective date constitutes acceptance of the updated Terms.

13. Governing law

These Terms are governed by the laws applicable to the contracting entity providing the Service to you, without regard to conflict-of-law rules, except where mandatory consumer protections in your jurisdiction require otherwise.
